1. Introduction and Acceptance of Terms

2. No Attorney-Client Relationship from Website Use

Your use of this website does not create an attorney-client relationship between you and the Law Offices of Mary Kennedy, LLC. An attorney-client relationship is formed only upon:

Execution of a written engagement letter (“Engagement Letter”) signed by both you and an authorized representative of the Firm; and The Firm’s confirmation of acceptance of representation following completion of conflict-of-interest checks.

Until both of these conditions are met, no information you submit through the website, contact forms, email, telephone, or other channels will be treated as forming an attorney-client relationship. We strongly encourage you not to send confidential or sensitive information until such a relationship is formally established.

4. Engagement Letter Controls

Where the Firm formally represents you, the terms of your signed Engagement Letter will govern the scope of representation, fees, and all other terms specific to your matter. In the event of any conflict or inconsistency between these Terms and your Engagement Letter, the Engagement Letter shall control with respect to the legal services described therein.

5. Fees and Payment

  • 5.1 Attorney Fees

Attorney fees for legal services are governed exclusively by your signed Engagement Letter. Estimates provided during consultations are not binding offers and are subject to change based on the complexity of your matter, scope changes, and other factors disclosed at the time of engagement.

  • 5.2 Government Filing Fees

Government filing fees, biometric service fees, premium processing fees, and other government-imposed costs are separate from attorney fees and are set by the relevant government agencies (including USCIS, the U.S. Department of State, and the Department of Labor). These fees are subject to change without notice. For example, USCIS has announced premium processing fee increases effective March 1, 2026, and additional fee changes may take effect during the course of your representation.
USCIS no longer accepts paper checks or money orders for most filings. Payments to USCIS must be made by credit card, debit card, or ACH transfer. Your engagement letter will outline how government fees are collected and remitted.

  • 5.3 Payment Methods

The Firm accepts payment by credit card, debit card, electronic bank transfer, and other approved methods identified in your Engagement Letter. All payments are subject to applicable processing fees disclosed at the time of payment.

6. Communications with the Firm

  • 6.1 General Communications

Our standard business hours are Monday through Friday, 9:00 AM to 5:00 PM Central Time, excluding federal and Illinois state holidays. While we strive to respond promptly to all inquiries, response times may vary based on case complexity, current immigration agency activity, and staff availability.

  • 6.2 SMS and Text Message Consent

By providing your mobile telephone number and opting in, you consent to receive SMS or text messages from the Law Offices of Mary Kennedy, LLC related to your case, appointment reminders, deadline notifications, and firm communications. Message and data rates may apply. Message frequency varies depending on your case activity.

You may opt out of SMS messages at any time by replying with any of the following keywords: STOP, QUIT, END, CANCEL, REVOKE, OPT OUT, or UNSUBSCRIBE. We will honor opt-out requests within ten (10) business days, consistent with current Federal Communications Commission (FCC) rules under the Telephone Consumer Protection Act (TCPA). For assistance, reply HELP or contact our office directly.

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Text message enrollment data and consent records are retained internally for compliance purposes only.

  • 6.3 Email and Electronic Communications

Email and other electronic communications are not fully secure. While we take reasonable measures to protect electronic communications, you acknowledge that information sent by email may be intercepted, lost, or altered. For highly sensitive matters, we may direct you to use our secure client portal.

In light of expanded federal vetting procedures (including the establishment of the USCIS Vetting Center in December 2025 and broader social media review under Executive Order 14161), clients should exercise heightened care with all electronic communications related to their immigration matters.

7. Online Services and Client Portal

The Firm may provide access to secure online client portals for document sharing, case status updates, and communications. Your use of any such portal is subject to additional terms presented at the time of registration. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities conducted through your account
  • Promptly notifying the Firm of any unauthorized access or suspected security breach
  • Using the portal only for lawful purposes related to your representation

8. Service Limitations and Disclaimers

  • 8.1 No Guaranteed Outcomes

The Firm does not and cannot guarantee any particular outcome, approval, or processing time in your immigration matter. Immigration decisions are made by federal agencies (USCIS, U.S. Department of State, EOIR, etc.) and are subject to their discretion, applicable law, and current policy direction.

  • 8.2 Policy Volatility and Processing Delays

Immigration law and policy have undergone significant changes during 2025–2026, including but not limited to:

  • Expanded travel restrictions affecting nationals of certain designated countries
  • Processing holds and delays announced by USCIS for certain application categories
  • Re-review processes for certain previously approved immigration benefits
  • Enhanced vetting procedures including social media disclosure requirements
  • Changes to Employment Authorization Document (EAD) validity periods and automatic extension rules
  • Increased filing fees and changes in accepted payment methods

Such changes may affect the timing, requirements, or outcome of your matter. The Firm will make reasonable efforts to keep you informed of material developments affecting your case but does not warrant continuous notification of every policy change.

  • 8.3 Reliance on Client-Provided Information

Our representation depends on the accuracy and completeness of information and documents you provide. You agree to provide truthful, accurate, and complete information and to promptly notify the Firm of any changes in your circumstances (including address, employment, marital status, criminal history, or travel) that may affect your case. The Firm is not responsible for adverse outcomes arising from inaccurate, incomplete, or untimely information provided by you.

  • 8.4 Website Availability

We strive to maintain website availability but do not warrant that the website will be uninterrupted, error-free, or free from harmful components. We reserve the right to modify, suspend, or discontinue any portion of the website at any time without notice.

9. Force Majeure

  • 17.2 Venue

Any legal action or proceeding arising out of or related to these Terms or your use of the website shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of such courts.

  • 17.3 Fee Disputes

Fee disputes arising out of legal representation are governed by the Illinois Supreme Court rules and the Attorney Registration and Disciplinary Commission (ARDC) procedures, including, where applicable, the Illinois Attorney Fee Dispute Resolution Program.
